Red Light Camera tickets ruled constitutional. . .for now

Consider this a temporary setback in our fight against these Red Light Cameras.  Yesterday, a local judge ruled that Red Light Cameras do not violate a citizens due process rights as was argued by some local attorneys.  Broward County Judge Steven P. DeLuca wasn't buying the angle that these tickets are "coercive" as they force the driver to pay up rather than declare their innocence.

This is not a "death blow" by any means, as it only applies in Judge DeLuca's courtroom.  It's not even a fatal blow should your case wind up in his courtroom, as Judge DeLuca has dismissed over 750 Red Light Camera tickets that have come before him, and there is no indication that he will stop dismissing them if the proper argument is presented to him.  This ruling was only one, in what is going to be a long list of challenges to these tickets.

The good news is that we are still fighting them and the courts are still allowing us to present legal arguments that we can use to get these dismissed.

On another note, officials in Clearwater have moved closer to deciding to not even install Red Light Cameras as they are not worth the hassle (see  here).  Let's hope the argument isn't decided in the court of law, but in the court of public opinion, and these cameras will become a distant memory.

Cameras are deffinitely a cash grab. In Ontario, Canada red light camera offences are on the rize and as it stands absolutely legal and enforceable.

It's so unfortunate that many people don't fully understand that these cameras are not about public safety. If it were, they would make the yellow stay on longer, and position a police officer at the "dangerous intersections." It would be cheaper and probably save more lives. But it wouldn't make headlines.
